Directive on the Application of Species at Risk Act Section 33 (Residence) to Aquatic Species at Risk
Under the federal Species at Risk Act (SARA), residence is a dwelling-place, such as a den, nest or other similar area or place, that is occupied or habitually occupied by one or more individuals during all or part of their life cycles, including breeding, rearing, staging, wintering, feeding or hibernating. The Directive on the Application of Species at Risk Act Section 33 (Residence) to Aquatic Species at Risk describes how Fisheries and Oceans Canada (DFO) will interpret and implement section 33 of SARA.
DFO invites you to familiarize yourself with the process by which DFO identifies residence for an endangered, threatened, or threatened aquatic species.
