SPECIES AT RISK ACT

Order Fixing March 24, 2003 as the Date of the Coming into Force of Certain Sections of the Act

Her Excellency the Governor General in Council, on the recommendation of the Minister of the Environment, pursuant to section 142 of the Species at Risk Act, assented to on December 12, 2002, being chapter 29 of the Statutes of Canada, 2002, hereby fixes March 24, 2003 as the day on which sections 1, 134 to 136 and 138 to 141 of the Act come into force.

EXPLANATORY NOTE

(This note is not part of the Order.)

The Order fixes March 24, 2003 as the day on which certain provisions of the Species at Risk Act, assented to on December 12, 2002, being chapter 29 of the Statutes of Canada, 2002, come into force. These provisions amend certain related laws on the protection of species of plants and animals.

Canada Wildlife Act

The amendments to this Act allow the Governor in Council to authorize the Minister of the Environment to exercise certain powers over public lands administered by another federal minister. These amendments also allow the Governor in Council to make regulations prohibiting access to these lands, prescribing measures for the conservation of wildlife on such lands and respecting the establishment and maintenance of works for wildlife research, conservation and interpretation on such lands. These amendments also allow the Minister of the Environment to delegate any of his powers under this Act to another federal minister.

Migratory Birds Convention Act, 1994

The amendment to this Act authorizes the Minister of the Environment to delegate any powers under the provisions of this Act relating to the enforcement or issuance, renewal, revocation and suspension of permits.

Wild Animal and Plant Protection and Regulation of International and Interprovincial Trade Act

The amendments to this Act allow the Minister of the Environment to delegate authority under section 10 of this Act relating to permits. They also authorize the Governor in Council to amend the definition of "animal" and "plant" for the purposes of subsection 6(2) and section 8 of this Act.
